Who Is Eligible to File an Ethylene Oxide Exposure Lawsuit?

To file a lawsuit because of ethylene oxide exposure, a person must prove that they suffered severe injuries and damages because of this exposure. A clear link between your specific health condition and the exposure must be established and proven by medical evidence.

The following parties often have a higher risk of suffering from the effects of exposure because of their prolonged contact with the toxic chemical:

  • Medical professionals who use sterilized equipment
  • Plant workers at and those who live near sterilization or ethylene oxide-producing facilities
  • Warehouse and transport workers who handle sterilized equipment

What Is Ethylene Oxide?

Ethylene oxide is a colorless, flammable gas. This chemical plays a key role in producing polyester, antifreeze, textiles, and numerous other materials. In medical and pharmaceutical settings, ethylene oxide is widely employed as a sterilization agent for medical equipment and devices that cannot withstand high-temperature steam sterilization, effectively eliminating bacteria, viruses, and fungi.

While ethylene oxide is essential to many industrial processes, it is also recognized as a hazardous substance. Regulatory agencies classify the chemical as a potential carcinogen, and occupational exposure must be carefully managed through strict safety protocols, protective equipment, and controlled ventilation systems.

Ethylene Oxide Exposure Linked to Cancer & Birth Defects

Ethylene Oxide (EtO) is an extremely dangerous chemical manufactured and distributed throughout the United States. In 2022, 144 facilities submitted Toxic Chemical Release Inventory (TRI) forms for ethylene oxide (see data from the Environmental Protection Agency (EPA).

These chemical facilities have accidents that send Et0 into the air and/or water. Those accidents are called releases. Releases can be minor or very severe and have a compounding effect on the health of the people who live near the facilities. According to the EPA, in 2022 alone numerous facilities reported that 9,166 pounds of ethylene oxide had been released into the air.

The health effects of all those releases can result in very severe health issues. Ethylene oxide has been linked to the following types of cancer:

  • Stomach cancer
  • Breast cancer
  • Lymphomas
  • Leukemia
  • Mesotheliomas

Chronic exposure to EtO can also lead to the following effects:

  • Birth defects
  • Bronchitis
  • Kidney damage
  • Liver damage
  • Reproductive challenges
  • Spontaneous abortions
  • Nerve damage
